1.- Object
1.1 KURKO VISIÓN, SL, responsible for the website, makes this document available to users, with which it intends to comply with the obligations set forth in Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE), as well as to inform all users of the website, regarding the conditions of use of the site.
1.2 Any person who accesses this website and uses its services, or provides their data, assumes the role of user, committing to the observance and strict compliance with the provisions contained herein, as well as any other applicable legal provision.
1.3 The purpose of this contract is to regulate the provision of services offered through this website, and specifically, the sale of KURKO brand glasses.
1.4 The following is the contractual document that will govern the provision of our services and sale of products through the website: www.kurkovision.com, owned by KURKO VISIÓN, SL (hereinafter the provider). Acceptance of this document implies that the user:

- That is a person with sufficient capacity to hire.

- That assumes, and accepts, all the obligations set forth herein.
1.5 These terms and conditions will have an indefinite period of validity and will apply to all contracts made through the provider's website, until the publication of a new version.
2.- Identity of the parties
2.1. On the one hand, the provider, identified above, and on the other hand, the user, registered on the website and who will be responsible for the veracity of the personal data provided to the provider.
3.- Procurement procedure
3.1 The procurement procedure may be conducted in Spanish or English. If it can be carried out in another language, this will be indicated before the procurement procedure begins.
3.2 To access the services offered by the provider, users must register through the website, either as a user or to place a specific order. To do so, users must freely and voluntarily provide the required personal data.
3.3 During the contracting process, you will be informed of the different steps to follow and you will be able to modify the information entered, if necessary. The different steps to follow in the purchase process are as follows:

4.1 Payment for services can be made through the following channels:

5. Prices.
5.1 The prices shown for each of the services offered on the site do not include Value Added Tax (VAT).
5.2 The prices applicable to each service will be those published on the website or those offered in the form of offers and promotions on the website or in banners, commercial communications from the provider, etc
5.3 The invoice will be delivered along with the order placed.
5.4 If services other than those indicated above are agreed upon, different prices may be established.
5.5 For orders of fewer than 3 units, a shipping fee of €3.90 + VAT will be charged on the invoice.
6.- Deadlines
6.1 Generally speaking, delivery times will be 2-3 working days within the EU and approximately 4-6 working days for all other territories.
7.- Right of withdrawal
7.1 The user has the right to withdraw from this contract within fourteen (14) calendar days without needing to justify it, always communicating it in writing through the contact form on our website or through email to kurko@kurkovision.com
7.2 The aforementioned right of withdrawal will not apply to products made according to the buyer's specifications or clearly personalized. It also does not apply to goods that are unsuitable for return due to hygiene and health protection reasons.
7.3 The withdrawal period will expire fourteen (14) calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.
7.4 To exercise the right of withdrawal, you must always notify us in writing through the contact form on our website www.kurkovision.com or by email to kurko@kurkovision.com, of your decision to withdraw from the contract through an unequivocal statement.
7.5 You may use the contact form, although its use is not mandatory.
7.6 To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of this right before the withdrawal period expires.
Consequences of withdrawal
7.7 In the event of withdrawal by you, we will reimburse all payments received from you, excluding delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method we offer) without undue delay and in any event no later than fourteen (14) calendar days from the date on which we are informed of your decision to withdraw from this contract.
7.8 We will proceed to make said refund using the same payment method used by you for the initial transaction, unless you have expressly arranged otherwise; in any case, you will not incur any expenses as a result of the refund.
7.9 You will be responsible for arranging the shipment and bearing the direct cost of returning the goods.
7.10 You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
7.11 We may withhold reimbursement until we have received the goods and verified that none of the exceptions to the right of withdrawal apply or that the products have not been damaged.
8.- Shipping
8.1 Shipping is free for orders of 3 or more items. For orders of fewer than 3 items, the shipping cost will be €3.90 + VAT.
9. User Obligations
9.1 The user must take full responsibility for the confidential treatment and proper safekeeping of the passwords he or she possesses, preventing access to them by unauthorized third parties.
9.2 To contract services offered through this website, users are asked to provide certain information. The purpose of this request is to enable the contracting of services and to ensure the proper execution of the service. 10.1 All products sold through the website have a corresponding 2-year warranty, in accordance with the terms established in the relevant regulations.

13. Safeguard clause.
13.1 The possible invalidity or ineffectiveness of one or more clauses of these general conditions, due to any cause, will not determine the invalidity or ineffectiveness of the whole, which will remain valid and effective for all other clauses.
14.- Legislation and jurisdiction
14.1 The applicable law in case of dispute or conflict of interpretation of the terms that make up these Terms of Use, as well as any matter related to the Portal services, will be Spanish law.
14.2 For the resolution of any dispute that may arise in connection with the use of the Portal and its services, the parties agree to submit to the jurisdiction of the judges and courts of the user's domicile, or the one that, in each case, is established by the regulations on procedural matters and/or consumers and users.
